Information you provide directly: When you fill in our contact form or newsletter subscription, we collect your name, email address, phone number (if given), and message content.

Technical data: We automatically collect IP address, browser type, device type, pages visited, and referral source via cookies and similar technologies to improve site performance.

Communications data: Records of correspondence with us (email, chat).

3. How We Use Your Information

We use collected data to: respond to enquiries and service requests; send our newsletter (only if you subscribed — you may unsubscribe at any time); improve and maintain our website; comply with legal obligations; and prevent fraud.

We do not sell, rent, or trade your personal information to third parties.

We use essential cookies (required for the site to function) and analytical cookies (to understand how visitors use the site). You may decline non-essential cookies via the cookie banner. Disabling cookies may affect some site functionality.

5. Data Storage & Security

Your data is stored securely on Supabase (hosted on AWS infrastructure). We implement reasonable technical and organisational measures to protect your data against unauthorised access, alteration, or disclosure. No method of transmission over the Internet is 100% secure; we cannot guarantee absolute security.

6. Data Retention

We retain contact messages and enquiry data for up to 24 months. Newsletter subscriber records are kept until you unsubscribe. You may request deletion at any time.

7. Your Rights

You have the right to access, correct, or delete your personal data; object to or restrict processing; and withdraw consent at any time. To exercise these rights, email ikinaimedia@gmail.com. We will respond within 30 days.

8. Third-Party Links

Our website may contain links to third-party sites. We are not responsible for their privacy practices and encourage you to review their policies separately.

9. Children's Privacy

Our services are not directed at children under 13. We do not knowingly collect personal data from children.

1. Agreement to Terms

By accessing or using Ikinai Media's website and services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.

2. Services

Ikinai Media provides digital marketing, web development, branding, and related services. The specific scope, deliverables, timelines, and fees for each engagement are defined in a separate written agreement or proposal signed by both parties.

3. Payments

Invoices are payable within 14 days of issue unless otherwise agreed in writing. Late payments may attract interest at 2% per month. We reserve the right to suspend work on overdue accounts.

4. Intellectual Property

Upon full payment, clients receive ownership of custom deliverables created specifically for them. Ikinai Media retains rights to pre-existing tools, frameworks, templates, and general methodologies. We reserve the right to display completed work in our portfolio unless agreed otherwise in writing.

5. Client Responsibilities

Clients must provide timely feedback, accurate information, and necessary access to complete the work. Delays caused by the client may affect agreed timelines and costs.

6. Confidentiality

Both parties agree to keep confidential any non-public information shared during the engagement and not to disclose it to third parties without prior written consent.

7. Limitation of Liability

To the maximum extent permitted by law, Ikinai Media's total liability for any claim arising from our services shall not exceed the total fees paid by the client in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

8. Termination

Either party may terminate a project engagement with 14 days' written notice. The client is liable for fees for work completed up to the termination date. Ikinai Media may terminate immediately for non-payment or breach of these terms.

9. Disclaimer of Warranties

Our services are provided "as is". We do not guarantee specific results (such as search engine rankings or sales figures), as these depend on many factors outside our control.

10. Governing Law & Disputes

These Terms are governed by the laws of Kenya. Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the jurisdiction of the courts of Nairobi, Kenya.

11. Changes to Terms

We may update these Terms at any time. We will notify users via our website. Continued use of our services after changes constitutes acceptance of the updated Terms.
